Terms of Use

These Terms of Use ("Terms") govern your access to and use of the WaysOfBeing platform, including www.waysofbeing.ai and app.waysofbeing.ai (together, the "Service"), provided by WaysOfBeing OÜ, a private limited company registered in Estonia ("WaysOfBeing", "we", "us"). By creating an account or using the Service, you agree to these Terms.

Draft for review. These Terms are a working draft pending external legal counsel review. They reflect our intended commitments and the operational reality of the platform. Specific clauses may be revised after counsel sign-off; material changes will trigger the policy refresh process described in Section 14.

1. Eligibility

You must be at least 18 years of age to use the Service. We do not currently offer the Service to minors. By creating an account you confirm that you meet this requirement.

2. Account registration & security

You are responsible for maintaining the confidentiality of your account credentials, for activity under your account, and for promptly notifying us at support@waysofbeing.ai if you suspect unauthorised use. We may suspend access pending investigation of suspected compromise.

3. The Service: what WaysOfBeing is — and is not

WaysOfBeing offers psychometric self-assessments, AI-assisted reflective prompts, and access to qualified coaches working within the Integral Coaching Canada methodology, for the purpose of supporting your personal and professional development.

Coaching is not therapy and not a medical service. WaysOfBeing is not a substitute for licensed mental-health care, medical diagnosis, or emergency services. If you are in crisis or believe you may be a danger to yourself or others, contact your local emergency services immediately. Within the EU you can call 112; in Estonia additionally 116 123 (Lifeline).

4. AI-assisted features & human review

Some Service features generate suggestions, prompts, and reflections using large language models. These outputs are produced by automated systems and may be wrong, misleading, or out of context. They do not constitute professional advice. You may request review of any AI-assisted suggestion by your assigned human coach at any time (see Privacy Policy §3 for your Article 22 right).

5. Acceptable use

You agree not to:

  • upload illegal content, malware, or intentionally harmful material;
  • use the Service to harass, threaten, defame, or harm any person;
  • attempt to access another user's account or content;
  • circumvent security or rate-limiting; reverse-engineer the Service;
  • scrape or systematically extract data without written permission;
  • use the Service to train competing AI models;
  • resell, sublicence, or commercially exploit the Service without a written agreement.

6. Your content & intellectual property

You retain all rights to the content you create on the Service ("Your Content") — your assessment answers, mission narratives, conversations with coaches, voice notes, etc. You grant WaysOfBeing a limited, non-exclusive licence to host, store, transmit, encrypt, decrypt, and process Your Content solely as necessary to operate the Service for you and to fulfil our legal and contractual obligations.

We do not use Your Content to train AI models, develop new products, advertise, or share with third parties beyond the necessary sub-processors disclosed in our Sub-processors page. Our agreements with each sub-processor explicitly forbid them from training on your data.

The Service itself, including its software, designs, methodologies, and the coaching frameworks (Integral Coaching Canada, where licensed), remains the intellectual property of WaysOfBeing or its licensors.

7. Coaching engagements (B2C)

When you contract directly with WaysOfBeing for coaching, the engagement terms (number of sessions, duration, fees) will be set out in your order confirmation. Cancellations and refunds are governed by EU consumer law and the specific cancellation terms in your order. The 14-day right of withdrawal under EU Consumer Rights Directive applies, except where you have explicitly requested coaching to begin during the withdrawal period and acknowledged that the right ends once the service has been fully performed.

8. Coaching engagements (B2B, via employer)

Where your employer has contracted coaching for you through Integral Coaching Canada or another delivery partner, the contract for delivery is between your employer and the delivery partner. WaysOfBeing OÜ provides the platform under a separate platform agreement. Your privacy rights with respect to coaching content are unaffected — see Privacy Policy §2 and §5.

9. Payment & billing

Payments are processed by Stripe (Stripe Payments Europe Ltd for EEA cardholders). VAT is charged where applicable. Invoices are retained for 10 years per Estonian tax law. Disputed charges should be raised at support@waysofbeing.ai within 30 days of the invoice date.

10. Suspension & termination

You may delete your account at any time from your Privacy Settings page (see Privacy Policy §7 for the tiered erasure schedule). We may suspend or terminate your access if you breach these Terms or our Acceptable Use policy, or if continued provision of the Service exposes WaysOfBeing or other users to material legal, security, or safety risk. Where we terminate, we will provide notice and an opportunity to export Your Content unless prevented by legal obligation.

11. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, WaysOfBeing disclaims all warranties not expressly set out here, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Coaching is a developmental practice, not an outcome guarantee.

12. Limitation of liability

To the maximum extent permitted by applicable law, WaysOfBeing's total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the fees you paid to WaysOfBeing in the 12 months preceding the event giving rise to the claim, or (b) one hundred euros (€100). WaysOfBeing is not liable for indirect, incidental, consequential, or punitive damages, or for loss of profits, data, or business, except where such limitation is prohibited by law. Nothing in these Terms limits liability for fraud, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be limited by law.

13. Indemnity

You agree to indemnify WaysOfBeing against third-party claims arising from your breach of these Terms or your unlawful use of the Service, to the extent permitted by applicable law.

14. Changes to these Terms

We may update these Terms. Material changes (changes that meaningfully affect your rights, obligations, fees, or how your data is processed) will be notified at least 30 days in advance by email and in the Service, and will require fresh acceptance at next sign-in. Non-material changes (clarifications, typos, contact updates) take effect immediately on posting, with notice in the Service.

15. Governing law & dispute resolution

These Terms are governed by the laws of the Republic of Estonia. Disputes are subject to the exclusive jurisdiction of the Estonian courts (Harju County Court), without prejudice to your mandatory consumer rights to bring a claim in your country of residence under Article 18 of the Brussels I bis Regulation (1215/2012). EU consumers may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remainder remains in full effect and the invalid provision will be replaced with an enforceable term that most closely reflects the parties' original intent.
